GFT filed an alternative Writ of Mandamus in the Superior Court of Guam last Tuesday, September 13, 2016 seeking an order to the Director of the Guam Behavioral Health and Wellness Center and the Director of the Department of Administration to perform their duty as required and mandated by 4 GCA § 6225.1.  The Guam law, effective since October 2015, requires the two Directors to meet and identify the personnel directly exposed to hazardous working conditions and ensure they receive the Hazardous pay as well as develop a protocol for personnel who are not regularly exposed to hazardous working conditions to receive the Hazardous pay at the times they were exposed to hazardous conditions.  However, this has still not been done, virtually a year later.  
 
GFT Members of the Guam Behavioral Health and Wellness Center, consisting of Psychiatric Technicians and Nurses, raised these concerns to GFT as they experience hazardous working conditions on a daily basis dealing with patients that suffer from illnesses prone to unpredictable physical fits of rage and anger.  Employees of the Department received the Hazardous pay from 2000 to 2012.  Public Law 33-16 reinstated the Hazardous pay to the employees beginning October 2015, but they have yet to receive the ten percent Hazardous Pay differential mandated by law, and GFT is taking these Directors to Court to get it for them.  View Petition for Writ here
